General Terms and Conditions of Megacenter Eindhoven
Established at 5613 DX Eindhoven, Ruysdaelbaan 43. Available by phone at: 040-213 3450. These general terms and conditions apply to orders placed on www.megacenter.com.
Article 1 VAT (Value Added Tax)
1.1 All listed prices include 21% VAT.
Article 2 Delivery
2.1 Deliveries are made via parcel post.
Article 3 Liability
3.1 We do not accept liability if it appears that information posted on the webshop is incorrect.
3.2 Liability for direct and indirect damages is excluded.
Article 4 Privacy
4.1 Your personal data will be treated confidentially by us and will never be passed on to third parties or used for commercial purposes.
Article 5 Termination
5.1 If one or more items are not deliverable, we reserve the right to terminate the order/purchase agreement.
Article 6 Images
6.1 Images shown on the site may slightly differ from the original.
Article 7 Prices
7.1 Prices on the webshop may differ from the actual price in the department store.
Article 8 Ownership
8.1 We remain the full owner of an item sold by us until the purchase price has been fully paid.
Article 9 Payment
9.1 Payment for the products must be made via the payment methods on our website.
Article 10 Warranty
10.1 We provide a manufacturer's warranty on all products we offer.
10.2 If it appears that an item is defective, you must always contact us first before returning the product. Please state the reason why you want to return the product.
10.3 Items can only be returned with prior permission from us.
10.4 Upon delivery of the products, the buyer must carefully inspect them and report any defects immediately.
10.5 If it is found that the buyer has attempted to repair the item themselves or that the repair was not carried out by Megacenter Department Store, the entire warranty will be void. All shipping and repair costs will then be borne by the buyer.
10.6 The warranty also expires if:
- 10.6a The buyer has neglected the items.
- 10.6b The defect or damage is caused by improper or careless use (e.g., incorrect connection, incorrect voltage, moisture, lightning, etc.).
- 10.6c The buyer has treated the product negligently in any other way. - 10.6d The type or serial number of an item has been removed or altered.
Article 11 Returns
11.1 You have the right to cancel your order up to 14 days after receipt without giving any reason. After cancellation, you have another 14 days to return your product. Download the form here to report a return shipment.
11.2 If you use your right of withdrawal, the product, with all delivered accessories and – if reasonably possible – in its original condition and packaging, must be returned to us. If the product is damaged or the packaging is more damaged than necessary to try the product, we can charge you for this depreciation. Therefore, handle the product with care and ensure that it is properly packed for a return. 11.3 If upon dispatch the recipient refuses to accept or is negligent in providing information or instructions necessary for delivery, the recipient is liable for all incurred shipping costs (both for the insured return shipment and the sent order).
11.4 Return shipping costs are borne by the buyer.
11.5 After receipt and inspection of the returned goods, we will refund the amount within 14 days.
Article 12 Complaints
12.1 It can always happen that something does not go as planned. We recommend that you first make complaints known to us by emailing [email protected]. If this does not lead to a solution, it is possible to submit your dispute for mediation via Stichting WebwinkelKeur at https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil. From February 15, 2016, it is also possible for consumers in the EU to submit complaints via the ODR platform of the European Commission. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not already being processed elsewhere, you are free to file your complaint via the platform of the European Union.
Article 13 Final Provision
13.1 All agreements concluded by Megacenter Department Store are exclusively governed by Dutch law.
